MOORE YOGA | MASTER TERMS OF ENGAGEMENT

1. ASSUMPTION OF RISK, RELEASE, AND LIMITATION OF LIABILITY By participating in any yoga instruction, class, workshop, or event (the "Session") organized or conducted by Moore Yoga, the participant (the "Student") acknowledges and agrees that yoga involves physical exertion, which may be strenuous and may cause physical injury. The Student is fully aware of the risks and hazards involved. The Student hereby represents that they are physically fit and have no medical condition that would prevent full participation in the Session. In consideration of being permitted to participate in the Session, the Student agrees to assume full responsibility for any risks, injuries, or damages, known or unknown, which might be incurred as a result of participating in the program. The Student knowingly, voluntarily, and expressly waives any claim they may have against Moore Yoga, its instructors, owners, or employees for injury or damages that may be sustained as a result of participating in the Session. This release includes, without limitation, injuries which may occur as a result of (a) use of any exercise equipment or facilities which may malfunction or break, (b) improper maintenance of any exercise equipment or facilities, (c) any slip, fall, or dropping of equipment, and (d) instruction, training, or supervision by Moore Yoga.

2. MEDICAL DISCLAIMER AND PROFESSIONAL ADVICE WAIVER The information, instructions, and sequences provided during Moore Yoga Sessions are for wellness and educational purposes only and do not constitute medical advice, diagnosis, or treatment. Moore Yoga and its instructors are not licensed medical professionals, physicians, or physical therapists. Participation in any Moore Yoga Session does not create a doctor-patient relationship. The Student is strongly advised to consult with a physician prior to commencing any new exercise regime. The Student should never disregard professional medical advice or delay in seeking it because of something learned during a Moore Yoga Session. The Student acknowledges that Moore Yoga does not and cannot guarantee any specific health outcome, healing of ailments, or resolution of physical or mental conditions.

3. VERIFICATION OF PHYSICAL SOUNDNESS AND SKILL LEVEL COMPLIANCE The Student warrants and represents that they are in good physical condition and have no disability, impairment, or ailment preventing them from engaging in active or passive exercise that will be detrimental to their health, safety, comfort, or physical condition if they do so engage or participate. The Student specifically agrees to only enroll in Sessions for which they are physically and technically qualified. Moore Yoga reserves the absolute and unilateral right to evaluate the Student’s physical performance and, should the instructor determine in their sole discretion that the Student is not physically sound for the specific level of instruction, Moore Yoga may mandate that the Student cease participation or move to a more appropriate level of instruction for the safety of the Student and others.

4. PROFESSIONAL LICENSURE AND EXPERT SCOPE Moore Yoga provides instruction through a professionally licensed and insured practitioner. Our services are backed by verified Professional Licenses and advanced training credentials to ensure the highest standard of safety and alignment. The Student acknowledges that they are receiving instruction from a credentialed professional and agrees to adhere to the expert cues and safety adjustments provided during the Session.

5. STRICT NON-REFUNDABLE PAYMENT POLICY Moore Yoga operates under a strict "No Refund" policy. All payments made for single classes, punch cards, multi-class passes, monthly memberships, specialized workshops, private sessions, or corporate retreats are final and non-refundable under any circumstances, including but not limited to: Student illness, scheduling conflicts, relocation, or dissatisfaction with the service. Payments cannot be transferred to other individuals. No pro-rated refunds will be issued for unused portions of memberships or class packs.

6. NO-CALL, NO-SHOW AND LATE ARRIVAL POLICY Attendance at scheduled Sessions is the sole responsibility of the Student. In the event of a "No-Call, No-Show," where the Student fails to attend a scheduled Session without providing the required prior notice as specified by Moore Yoga, the Student shall automatically forfeit the entirety of the fee paid for that Session. For Students utilizing punch cards or memberships, one (1) Session will be deducted from their balance as if they had attended. Furthermore, late arrivals exceeding five (5) minutes past the scheduled start time may be denied entry to the Session to prevent disruption of the meditative environment; such instances will be categorized as a No-Show and are subject to the same forfeiture terms.

7. CANCELLATION RECOVERY AND SERVICE CREDITS In the specific event that Moore Yoga must cancel a Session due to instructor emergency, illness (utilizing instructor sick-time protocol), facility closure, or other unforeseen administrative reasons, the Student will not be entitled to a cash refund. Instead, Moore Yoga will provide the Student with a credit of equal value to be applied to a future Session or, at the discretion of Moore Yoga, a digital gift card issued for the exact amount spent. This credit or gift card represents the sole and exclusive remedy available to the Student for a cancellation initiated by Moore Yoga.

8. ON-LOCATION GEOGRAPHIC RADIUS AND TRAVEL SURCHARGES On-location sessions are provided within a strictly defined geographic service area. Any session requested at a location residing outside of the Moore Yoga standard service radius (determined by the studio’s primary business address) shall be subject to a mandatory travel surcharge. This surcharge is calculated based on current mileage rates or a flat-rate extended-distance fee as determined by Moore Yoga. The Student or Client must disclose the exact physical address of the requested location at the time of booking to receive a quote for travel fees. Moore Yoga reserves the right to refuse service to any location deemed to be at an unreasonable distance or in an inaccessible area.

9. ON-LOCATION PET POLICY AND ENVIRONMENTAL SAFETY While Moore Yoga supports a pet-friendly environment for on-location "Bespoke" sessions, the Student/Client is responsible for ensuring pets do not interfere with the safety or technical rigor of the Session. Moore Yoga reserves the right to pause or terminate a session without refund if a pet’s behavior poses a safety risk to the instructor or the Student. The Student assumes all liability for any pet-related incidents during the Session.

10. WEATHER CONTINGENCY AND RELOCATION PROTOCOLS For all Sessions scheduled at outdoor or off-site locations, Moore Yoga reserves the ultimate right to cancel or postpone the Session due to inclement weather or unsafe environmental conditions (including but not limited to: rain, lightning, extreme temperatures, poor air quality, or high winds). If a session is canceled due to weather, the Student will receive a credit as outlined in Section 7. A Session may only be moved from an outdoor location to an indoor studio backup if such an arrangement was formally requested, approved, and documented in writing at the time of the original booking. If no prior studio arrangement exists, the Session is considered canceled.

11. SKILL BUILDING WORKSHOP LOCATION AND VENUE STANDARDS Unless an alternative location is explicitly approved in writing by Moore Yoga, all Skill Building Workshops are contracted to take place at the Client’s primary place of business. The Client assumes all responsibility for providing a venue that is clean, structurally sound, safe, and free from excessive noise or distraction. The Client warrants that the venue complies with all local health and safety regulations. Moore Yoga reserves the right to terminate a workshop immediately without refund if the provided venue is found to be unsafe or significantly different from the description provided at the time of booking.

12. ON-LOCATION BOOKING LOGIC AND CUSTOM SITE APPROVAL Moore Yoga utilizes a tiered booking system for off-site instruction. The Student may select from a pre-approved list of vetted locations. If the Student requests a "Custom Location" not appearing on the approved list, they must submit a formal inquiry form at least seven (7) days in advance. This form must include details regarding the floor surface, parking availability, and area privacy. Moore Yoga reserves the unilateral right to deny a Custom Location request if the site is deemed unsuitable for yoga practice or instructor safety.

13. ZERO-TOLERANCE POLICY FOR HORSEPLAY AND DISRUPTIVE CONDUCT To maintain the safety and sanctity of the practice space, Moore Yoga enforces a zero-tolerance policy regarding horseplay, roughhousing, or any form of reckless physical behavior. Any Student engaging in such activities, or any behavior deemed disruptive, disrespectful, or dangerous by the instructor, will be required to vacate the premises immediately. Such removal shall be permanent for the duration of that Session and will not result in a refund, credit, or rescheduling opportunity.

14. GROUP ETIQUETTE AND RIGHT TO REFUSE SERVICE Every Student is entitled to a peaceful and respectful environment. Harassment, discriminatory language, or aggressive behavior toward instructors or other Students will not be tolerated. Moore Yoga reserves the right to refuse service to any individual for any reason, including but not limited to: violation of studio policies, being under the influence of controlled substances, or repeated failure to follow safety instructions.

15. ATTIRE, FOOTWEAR, AND PERSONAL ACCESSORY REQUIREMENTS For the prevention of injury and to ensure proper alignment, Students must wear appropriate athletic attire that allows for full range of motion. Yoga is strictly a barefoot practice; all footwear must be removed prior to stepping onto the practice surface. The wearing of long, dangling jewelry or sharp accessories is prohibited during practice as they pose a risk of injury to the Student or damage to Moore Yoga equipment.

16. PERSONAL HYGIENE AND SCENT-AWARE ENVIRONMENT POLICIES As yoga involves deep respiratory engagement in a shared environment, Moore Yoga requires Students to maintain high standards of personal hygiene. We operate a "Scent-Aware" environment; Students are requested to refrain from the use of heavy perfumes, colognes, or strongly scented body products that may cause allergic reactions or respiratory distress for others. Students using Moore Yoga rental equipment agree to sanitize said equipment after use with the provided cleaning agents.

17. MANDATORY EQUIPMENT AND RENTAL MAT AGREEMENT It is the primary responsibility of the Student to provide their own yoga mat and hydration for every Session. In the event a Student is without a mat, Moore Yoga may provide a rental mat for a non-refundable fee of $5.00 per session. Rental mats are subject to availability and are issued on a first-come, first-served basis. Moore Yoga makes no guarantee that a rental mat will be available for every Student.

18. FINANCIAL ACCOUNTS, HSA, AND CLUB MEMBERSHIPS Moore Yoga provides specialized receipts for sessions that may be Health Savings Account (HSA) or FSA eligible; however, the Student acknowledges that Moore Yoga cannot guarantee insurance reimbursement. Determination of eligibility is made solely by the client’s insurance provider. All club memberships, loyalty points, or accrued "holiday" benefits are non-transferable and subject to the specific terms of the offering at the time of purchase.

19. INTELLECTUAL PROPERTY, MEDIA RELEASE, AND DATA PRIVACY All yoga sequences, instructional methods, workshop curricula, and digital or printed materials provided by Moore Yoga are the exclusive intellectual property of Moore Yoga and may not be recorded, reproduced, or redistributed without express written consent. Furthermore, by attending a Session, the Student grants Moore Yoga a perpetual, royalty-free license to use their likeness in photographs or videos taken during the Session for promotional and marketing purposes. Students wishing to opt out of media capture must notify the instructor in writing prior to the start of the Session. Moore Yoga agrees to protect Student data and will not sell personal information to third-party entities.

20. MINIMUM CAPACITY AND SESSION CANCELLATION Moore Yoga reserves the right to cancel any group session that does not meet the minimum required capacity. In the event of a cancellation by Moore Yoga due to low enrollment, participants who have already remitted payment will receive a service credit for the full value of the session to be applied toward a future class. These credits are strictly non-refundable, non-transferable to other individuals, and must be utilized within 90 days of the date of issuance. Credits not redeemed within this 90-day window will be forfeited.
